Throughout these Terms, “UrbanTreasuresArt,” “we,” “us,” and “our” refer to UrbanTresuresArt, operating the UrbanTreasuresArt online store. “You” and “your” refer to any person who visits our website, creates an account, places an order, purchases a product, or otherwise uses our Services.

By visiting our website or purchasing something from us, you agree to be bound by these Terms and any additional policies referenced in them, including our Refund Policy, Shipping Policy, and Privacy Policy.

Please read these Terms carefully before using our website or purchasing our products. If you do not agree to these Terms, you must not access or use our Services.

1. Online Store and Shopify

Our online store is hosted through Shopify, which provides the ecommerce platform that allows us to offer and sell our products to you.

Your purchase is made from UrbanTreasuresArt, not Shopify. Shopify is not responsible for manufacturing, fulfilling, shipping, replacing, or refunding products purchased from our store.

Some features of the Services may be operated by Shopify or other third-party providers and may be subject to their own terms and policies.

2. Eligibility

By using our Services, you represent that:

  • You are at least the age of majority in your state, province, or country of residence; or

  • You are using the Services with the permission and supervision of a parent or legal guardian; and

  • You have the legal authority to enter into a binding agreement.

You may not use our products or Services for any unlawful, fraudulent, unauthorized, or abusive purpose.

3. Our Products

UrbanTreasuresArt sells physical, print-on-demand wall art and related products, which may include:

  • Posters;

  • Framed posters and prints;

  • Canvas prints;

  • Photographic or fine-art prints;

  • Decorative wall art; and

  • Other made-to-order home or dorm décor products.

Our products are produced after an order is placed. Unless a product listing states otherwise, our products are not pre-manufactured or held in inventory.

Specific product materials, dimensions, framing options, finishes, colors, and other details are provided in each product listing. Customers are responsible for reviewing the entire listing before purchasing.

4. Product Images and Color Variations

We make reasonable efforts to accurately display our products. However, product photographs and mockups are provided for illustrative purposes.

The appearance of the finished product may vary slightly due to:

  • Monitor or mobile-device display settings;

  • Screen brightness and color calibration;

  • Printing methods;

  • Paper, canvas, ink, or framing materials;

  • Manufacturing tolerances;

  • Product size;

  • Image cropping or scaling; and

  • Lighting conditions.

Mockups may not represent the exact size or scale of a product in a particular room. Customers should review the listed measurements before ordering.

Minor differences in color, positioning, dimensions, or finish that are normal for the printing and manufacturing process are not necessarily considered defects.

5. Print-on-Demand Fulfillment

Our products may be manufactured, packaged, and shipped by third-party print-on-demand production partners.

By placing an order, you acknowledge that:

  • Your product may be manufactured by a third-party fulfillment provider;

  • Products from the same order may be produced at different facilities;

  • Items from the same order may arrive in separate packages;

  • Production and shipping locations may vary;

  • Packaging may differ by product or fulfillment location; and

  • Production times may increase during holidays, promotions, severe weather, or periods of high order volume.

UrbanTreasuresArt remains your point of contact for questions regarding your order.

6. Orders and Order Acceptance

Submitting an order does not guarantee that the order has been accepted.

We reserve the right to reject, limit, place on hold, or cancel an order for reasons including:

  • Suspected fraud or unauthorized payment activity;

  • Incorrect product or pricing information;

  • Technical or inventory errors;

  • Payment processing problems;

  • Inability to fulfill the selected product;

  • Violation of these Terms;

  • Orders placed with false or incomplete information; or

  • Events outside our reasonable control.

An order confirmation acknowledges that we received your order. It does not necessarily mean that production has begun or that the order has been accepted for fulfillment.

If we cancel an order after payment has been collected, we will generally issue a refund to the original payment method, subject to applicable payment-processing timelines.

7. Customer Information

You agree to provide complete, current, and accurate information when placing an order, including:

  • Your full name;

  • Email address;

  • Billing information;

  • Shipping address; and

  • Payment information.

You are responsible for reviewing your order confirmation and promptly reporting any mistakes.

We are not responsible for delays, failed deliveries, or additional costs resulting from incorrect, incomplete, or outdated information provided by the customer.

8. Prices and Payments

All prices are displayed in the currency identified on our website unless otherwise stated.

Prices may change without notice. The price charged will generally be the price displayed when your order is submitted, subject to the correction of obvious errors.

You agree to pay all charges associated with your order, including:

  • The product price;

  • Shipping charges;

  • Applicable sales taxes;

  • Customs duties or import charges when applicable; and

  • Other charges disclosed during checkout.

Payments may be processed by Shopify Payments or another third-party payment processor.

By submitting payment information, you represent that:

  • The information is accurate;

  • You are authorized to use the selected payment method; and

  • The payment provider may process the amount shown at checkout.

We are not responsible for declined transactions, account holds, processing delays, currency-conversion fees, or other issues caused by your bank, card issuer, or payment provider.

9. Taxes, Customs, and Import Fees

Applicable sales taxes may be calculated and collected during checkout.

International customers may be responsible for customs duties, import taxes, brokerage fees, handling charges, or other government-imposed costs that are not included in the product or shipping price.

Unless otherwise stated at checkout, customers are responsible for these charges. Refusing a package because of customs or import charges may not qualify the customer for a full refund.

10. Production and Shipping

Because our products are made to order, each order may require both:

  1. A production or fulfillment period; and

  2. A shipping or transit period.

Production and delivery estimates displayed on our website, during checkout, or in an order confirmation are estimates and are not guaranteed delivery dates.

Delays may occur because of:

  • Production volume;

  • Carrier delays;

  • Weather;

  • Holidays;

  • Customs inspections;

  • Incorrect addresses;

  • Labor interruptions;

  • Supply shortages;

  • Natural disasters;

  • Government actions; or

  • Other circumstances outside our reasonable control.

11. Separate Shipments

Products may be produced at different facilities or require different production times. As a result, items purchased in the same order may be shipped separately and arrive on different dates.

A customer will not necessarily be charged additional shipping solely because we divide an order into multiple packages after checkout.

12. Shipping Addresses and Address Changes

Customers are responsible for providing a complete and accurate shipping address.

Address-change requests must be submitted as quickly as possible to:

We cannot guarantee that an address can be changed after an order has been submitted. Print-on-demand orders may enter production quickly, and our ability to change an address depends on the order’s fulfillment status.

We are not responsible for packages that are delayed, returned, misdelivered, or lost because the customer provided an incorrect or incomplete address.

If a package is returned because of an address error, the customer may be responsible for the cost of producing and shipping a replacement, except where prohibited by law.

13. Order Cancellations and Changes

Because our products are made specifically for each customer, cancellation and modification requests must be submitted as soon as possible after ordering.

We cannot guarantee that an order can be canceled or changed once it has entered production.

Requested changes may include:

  • Product size;

  • Frame selection;

  • Color or design option;

  • Quantity;

  • Shipping address; or

  • Other product details.

Once production begins, we may be unable to cancel the order or change its specifications. Our acceptance or rejection of a cancellation request will depend on the order’s production status and applicable law.

14. Returns and Exchanges

Returns, exchanges, replacements, and refunds are governed by our Refund Policy, which is incorporated into these Terms.

Because our products are printed and manufactured to order, we may not accept returns or exchanges solely because:

  • The customer changed their mind;

  • The customer selected the wrong size;

  • The customer selected the wrong color, frame, or product option;

  • The product does not fit the customer’s intended space;

  • The customer no longer wants the product; or

  • The customer did not fully review the product description or measurements.

This limitation does not apply when a return, refund, repair, or replacement is required by applicable law.

Customers should not mail a product back to the return address shown on a shipping label without first contacting us and receiving return instructions.

Unauthorized returns may not be accepted or refunded.

15. Damaged, Defective, or Incorrect Products

Customers should inspect their order promptly after delivery.

If an item arrives damaged, defective, misprinted, or materially different from the product ordered, contact us at jackmorico21@gmail.com as soon as possible.

Please include:

  • Your full name;

  • Order number;

  • A description of the problem;

  • A photograph of the entire product;

  • Close-up photographs showing the damage or defect;

  • Photographs of the packaging and shipping label when relevant; and

  • Any other information reasonably requested to investigate the issue.

We may require photographs instead of requiring the damaged item to be returned.

After reviewing the claim, we may provide an appropriate resolution, such as:

  • A replacement;

  • A reprint;

  • A partial refund;

  • A full refund; or

  • Another remedy required by applicable law.

Claims involving normal color variation, minor manufacturing tolerances, or damage caused after delivery may not qualify for a replacement or refund.

16. Lost, Stolen, or Delayed Packages

A package may be considered delayed when it has not arrived by the estimated delivery date. Delivery estimates are not guarantees.

Customers should review tracking information and check:

  • The delivery location;

  • Mailboxes, porches, and entrances;

  • Building reception or mailrooms;

  • Household members;

  • Neighbors; and

  • Notices left by the carrier.

If tracking shows unusual delays or no movement, contact us at jackmorico21@gmail.com.

If tracking shows that a package was delivered but the customer cannot locate it, we may ask the customer to contact the shipping carrier or local delivery office. We will make reasonable efforts to assist, but a replacement or refund is not automatically guaranteed for packages confirmed as delivered.

Nothing in this section limits rights that cannot be waived under applicable consumer law.

17. Risk of Damage After Delivery

Customers are responsible for handling, installing, framing, hanging, and maintaining products safely after delivery.

UrbanTreasuresArt is not responsible for:

  • Damage caused by improper installation or hanging;

  • Damage caused by unsuitable hooks, nails, adhesives, or mounting equipment;

  • Damage to walls, furniture, or other property;

  • Fading caused by prolonged exposure to direct sunlight;

  • Moisture, humidity, fire, or environmental damage;

  • Damage caused by modifying, cutting, repainting, or reframing a product; or

  • Injury caused by improper handling or installation.

Customers should use mounting equipment appropriate for the product’s size, weight, frame, and wall material.

18. Intellectual Property

The UrbanTreasuresArt website and its contents—including artwork, designs, photographs, graphics, mockups, product descriptions, branding, logos, text, videos, and page layouts—are owned by or licensed to UrbanTreasuresArt and are protected by applicable intellectual-property laws.

Purchasing a physical product gives you ownership of that individual physical item. It does not transfer the copyright, trademark, reproduction rights, commercial-use rights, or other intellectual-property rights in the artwork or design.

You may display a purchased product for personal use. Unless you have our prior written authorization, you may not:

  • Copy or reproduce the artwork;

  • Scan, photograph, trace, or digitize the artwork for commercial use;

  • Sell reproductions of the artwork;

  • Use the artwork on merchandise;

  • Upload the artwork to a print-on-demand service;

  • Distribute digital copies;

  • Claim the artwork or design as your own;

  • Use the artwork in a logo, trademark, advertisement, or commercial brand; or

  • Create and sell substantially similar copies derived from our designs.

19. Third-Party Names and Trademarks

References to cities, schools, universities, teams, landmarks, businesses, organizations, or other third parties are descriptive unless expressly stated otherwise.

UrbanTreasuresArt is not affiliated with, sponsored by, endorsed by, or officially connected to any third party unless a product listing clearly states otherwise.

All third-party names, logos, trademarks, and other protected materials remain the property of their respective owners.

20. Copyright and Intellectual-Property Complaints

We respect the intellectual-property rights of others.

A rights holder who believes that content on our website infringes their rights may contact:

We may remove submitted content at our discretion.

25. Website Information and Errors

  • Shipping charges;

  • Product availability;

  • Production estimates; or

  • Delivery estimates.

We reserve the right to correct errors, update information, or cancel affected orders. If we cancel a paid order because of our error, we will generally refund the affected amount.

We do not guarantee that our website or Services will always be available, uninterrupted, secure, or error-free.

We may modify, suspend, restrict, or discontinue any part of the Services without notice, subject to our existing obligations for accepted orders and applicable law.

27. Disclaimer of Warranties

We do not guarantee that:

  • The Services will meet every customer’s expectations;

  • Printed colors will exactly match digital product images;

  • Products will appear identical to room mockups;

  • Production or delivery will occur by a particular date;

  • The website will be uninterrupted or error-free; or

  • Every technical issue can be corrected.

To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

Some jurisdictions do not permit certain warranty limitations, so some portions of this section may not apply to you.

28. Limitation of Liability

To the fullest extent permitted by law, UrbanTreasuresArt and its owners, employees, contractors, affiliates, licensors, production partners, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from:

  • Shipping or production delays;

  • Third-party services;

  • Improper installation or use of a product;

To the fullest extent permitted by law, our total liability for a claim involving a particular order will not exceed the amount paid to UrbanTreasuresArt for the product giving rise to that claim.
